Carol Berner to appeal conviction Thursday

The woman found guilty of impaired driving causing the death of a Ladner toddler is set to appeal her conviction this week.

Carol Berner is scheduled to appear in the B.C. Court of Appeal at 10 a.m. on Thursday, Nov. 10 where she is expected to appeal two counts of dangerous driving causing death and bodily harm, and two counts of impaired driving causing death and bodily harm.

In May 2008 four-and-a-half-year-old Alexa Middelaer was struck and killed at the side of an east Ladner road while feeding a horse with her aunt, who was seriously injured.

Berner was sentenced to two-and-a-half years in prison and handed a five-year driving ban, but was granted bail in late November 2010.

The Middelaer family continues to advocate for change to reduce impaired driving fatalities in B.C. Their Back the Bus campaign hopes to raise $250,000 to buy a mobile blood-alcohol testing unit for the province.
