A lawsuit from a group of citizens disputing the land deal between Bosa Properties and the City of White Rock has been dismissed.
According to a motion scheduled for release at the city's Jan. 24 council meeting, the dismissal is by consent of the petitioner, the Friends of White Rock Society.
"What it means is the case… was dropped by the group," city manager Peggy Clark said Friday. "It's a dismissal of their lawsuit against the City of White Rock. It's totally over and done with."
The society filed suit against the city in May 2006 in an effort to halt the land sale to Bosa and quash permits for the four-tower development, claiming the permits were improperly issued.
Two of the four Miramar Village towers have since been built in the town centre, on Johnston Road between Russell and Thrift Avenues.
Clark said the dismissal order was simply a process to remove the case from the Supreme Court registry. There hadn't been any action on the lawsuit for some time, she said. It caused little, if any, delay to the project, she said.
When the suit was filed, then-chief administrative officer Wayne Baldwin described it as frivolous.
Active members of the society could not be reached. One member named in the lawsuit, Joan Coulas, told Peace Arch News she hadn't been involved with the group "for a couple years," and had no knowledge of the dismissal.
The city's costs of the court action were not available Friday.
