Surrey cop's assault charge dismissed

Constable still faces charge in a separate case.

An assault charge against a Surrey RCMP officer was dismissed in court Thursday.

Const. Joseph Kane was facing a charge of assault causing bodily harm in connection with an April 2008 incident that occurred while the constable was off duty and allegedly assaulted an acquaintance.

However, Judge Ronald Caryer threw out the charge following a three-day trial in Surrey Provincial Court, ruling the officer did not use excessive force against the alleged victim.

Kane is currently on sick leave from the Surrey RCMP.

He also faces a separate charge – assaulting a civilian – in connection with a January 2008 traffic stop while he was on duty.

The trial for that case ran for several days last November and earlier this month and has been adjourned until March 7.
